§ 82-2. Transport into county and dumping of solid waste prohibited.

  • (a)

    No person, firm, corporation or employee of any municipality shall transport into the county garbage, trash, refuse, or any other solid waste for the purpose of dumping the same at any dump, landfill, or sanitary landfill located within the county.

    (b)

    This section shall not prohibit the dumping within the county of solid waste generated within the county.

    (c)

    Any permission or authority granted to any person, firm, corporation or employee of any municipality contrary to this section is hereby rescinded; provided, however, that any person, firm, corporation or employee of any municipality or county may request permission from the county board of commissioners.

    (d)

    Any person, firm or corporation or any employee or agent of any firm or corporation violating any provision of this section shall be subject to punishment in the county recorder's court by a fine of no more than $200.00 and no more than 60 days' imprisonment in the county jail.

    (e)

    The provisions of this section shall apply only to garbage, trash, waste or refuse generated within the state and not involved in interstate commerce.
